Terms of Service

Welcome to The Memory Gallery. These Terms of Service govern your use of our website and your purchase of products from The Memory Gallery.

By using our website or placing an order, you agree to these Terms of Service.

1. About Our Products

The Memory Gallery creates and sells fridge magnets, personalised products and other products designed to capture and preserve memories.

Some products are personalised or made to order using information, photographs, text or other details supplied by the customer.

2. Orders and Personalised Products

When placing an order, you are responsible for ensuring that all information, photographs, names, dates, spelling and other details supplied to us are correct.

Once a personalised order has entered production, changes or cancellations may not be possible.

Because personalised products are made specifically for you, they may not be returned simply because you have changed your mind or supplied incorrect personalisation details, subject always to your rights under applicable law.

3. Product Images and Colours

We make every reasonable effort to display product images and colours accurately. However, colours may appear slightly different depending on your device, screen settings, lighting and the materials used.

4. Pricing and Payment

All prices displayed on our website are in South African Rand (ZAR), unless otherwise stated.

We reserve the right to correct pricing or other errors on the website. If an error affects an order that you have placed, we will contact you as soon as reasonably possible.

Orders are only confirmed once payment has been successfully received.

5. Availability

We make every effort to keep product information and availability up to date. If a product becomes unavailable after an order has been placed, we will contact you and, where appropriate, arrange an alternative, replacement or refund.

6. Delivery

Delivery times are estimates and may vary depending on the delivery address, courier availability, public holidays, unforeseen circumstances and other factors outside our reasonable control.

Customers are responsible for providing a complete and accurate delivery address and contact information.

7. Damaged, Defective or Incorrect Products

If you receive a product that is damaged, defective or different from the product you ordered, please contact us as soon as possible after receiving your order.

We may request photographs and other information to assess the issue. Where appropriate, we will arrange a replacement, repair or refund in accordance with our Return and Refund Policy and applicable South African law.

You may not reproduce, copy, modify, distribute or commercially use our content without our prior written permission.

9. Customer-Supplied Content

Where you provide photographs, images, text or other content for a personalised product, you confirm that you have the necessary rights or permission to provide and use that content for the purpose of fulfilling your order.

We reserve the right to refuse content that is unlawful, offensive or inappropriate.

10. Website Use

12. Privacy

Personal information provided to us is handled in accordance with our Privacy Policy and applicable data-protection laws.

13. Governing Law

These Terms of Service are governed by the laws of the Republic of South Africa.
